关于票据纠纷案件审判中疑难问题探究

摘要: 票据是十分重要的支付结算工具，具有加快商品流通、促进市场经济发展的作用。其中，商业承兑汇票特别是电子票据在经济生活中的大量采用，为供应链上下游企业拓展商业信用，进一步降低企业短期融资成本提供了更加便捷的金融工具。由于立法工作的滞后性，各地法院对这些新情况、新问题产生了不同的认识，法律适用标准不尽统一。本文针对合法持票人的认定标准及举证责任分配问题进行深入探讨，提出参考意见，以期对完善票据法、修改司法解释和指导审判实践有所裨益。

Abstract: Bills are a very important payment and settlement tool, which has the role of accelerating commodity circulation and promoting the development of market economy. Among them, the large number of commercial acceptance bills, especially electronic bills, in economic life provides a more convenient financial tool for upstream and downstream enterprises in the supply chain to expand commercial credit and further reduce the short-term financing costs of enterprises. Due to the lagging nature of legislative work, courts in various places have different understandings of these new situations and issues, and the standards for the application of law are not uniform. This paper discusses in depth the identification standards and the allocation of the burden of proof for legitimate bearers, and puts forward reference opinions, in order to improve the Instrument Law, revise judicial interpretations and guide trial practice.
