剧本杀商家向玩家提供盗版剧本的规制

Regulations on Providing Pirated Scripts to Players by Script Murder Merchants

摘要: 提供剧本杀游戏服务的商家向玩家提供剧本以供其临时使用，其行为模式与我国《著作权法》中规定的出租权控制的行为特征相符合，但由于出租权保护的客体并不包括文字作品，因而商家出租盗版剧本的行为无法受到著作权法中出租权的规制。因剧本杀游戏中对剧本的表演不构成公开表演，商家的该行为也无法受到表演权所规制。从竞争关系和竞争行为的广义解释角度，出租盗版的剧本杀商家和剧本著作权人为反不正当竞争法所调整的主体，可以考虑将剧本杀商家出租盗版剧本的行为通过反不正当竞争法来规制。而选择适用反不正当竞争法哪一条款进行认定仍需斟酌，应严格适用一般条款，限制其适用范围，而对于符合商业秘密的剧本杀可以予以相对应的保护。

Abstract: Merchants providing script killing game services provide players with scripts for temporary use, and their behavior pattern is consistent with the behavior characteristics of rental rights control stipulated in China’s Copyright Law. However, since the object of rental rights protection does not include written works, the behavior of merchants renting pirated scripts cannot be regulated by rental rights in the Copyright Law. Due to the fact that the performance of the script in the script killing game does not constitute a public performance, the behavior of the merchant cannot be regulated by the performance rights. From the perspective of the competition relationship and the broad interpretation of competition behavior, the behavior of renting pirated scripts to kill businesses and the subject of script copyright adjusted by the Anti Unfair competition Law can be regulated through the Anti Unfair competition Law. However, it is still necessary to consider which provision of the Anti Unfair competition Law should be applied. The general provisions should be strictly applied to limit their scope of application, and the script that conforms to trade secrets can be correspondingly protected.
