政府采购领域公共竞争审查制度的理论检视与实施进路研究

Research on the Theoretical Inspection and Implementation of Public Competition Review System in Government Procurement

摘要: 政府采购活动在中国经济中扮演着重要角色，但其过程中存在着行政地位不平等、利益寻租和行政垄断等问题。这些问题对政府采购公平竞争产生负面影响，限制了资源的有效配置和市场的健康发展。因此，政府采购领域的公平竞争审查制度的理论检视和实施进路具有重要意义。本文旨在研究政府采购领域中公平竞争审查制度的问题及其完善建议，针对公平竞争审查在政府采购领域实施过程中出现的问题，如现行政府采购法律制度对限制竞争的规制不充分以及审查标准和审查模式方面存在不足等困境，提出相应的解决措施，建议可以通过在立法层面确认政府采购公平竞争审查制度、构建双重审查标准以及完善第三方评估等措施，推进政府采购市场的法治发展进程。

Abstract: Government procurement plays an important role in China’s economy, but there are such problems as unequal administrative status, interest rent-seeking and administrative monopoly. These problems have a negative impact on the fair competition of government procurement and restrict the effective allocation of resources and the healthy development of the market. Therefore, it is of great significance to inspect and implement the fair competition review system in the field of government procurement. This paper aims to study the problems of the fair competition review system in the field of government procurement and put forward some suggestions to improve it. In view of the problems in the implementation of the fair competition review in the field of government procurement, such as the insufficiency of the existing legal system of government procurement in the regulation of restricting competition, the insufficiency of the review standards and the review model, the author suggests that the legal development process of the government procurement market can be promoted by confirming the fair competition review system of government procurement at the legislative level, constructing double review standards and improving the third-party evaluation.
