用户使用夫妻共同财产进行直播打赏行为的法律分析

摘要: 已婚打赏用户使用夫妻共同财产在直播平台对主播进行打赏属于用户在直播平台的消费行为，但其行为是否为构成有权处分需经日常家事代理权规则的检视。为保护交易安全，直播平台公司的第三人利益有必要受到保护。在善意取得机制“失灵”的情况下，倘若已婚用户超出日常家事代理权限将夫妻共同财产用于充值打赏，应当认为该已婚打赏用户对相关夫妻共同财产拥有单独的处分权限，但同时其违反了其对配偶的信义义务。配偶方有权依据《民法典》第1092条或《民法典》1066条第1项在离婚时要求对方向其赔偿相应的损失或在婚姻存续期间请求法院终止夫妻财产共有制。

Abstract: The use of community property by married tipping users to reward the anchor on the live broadcast platform falls within the consumption behavior of the users on the live broadcast platform, but whether such behavior constitutes an authorized disposition shall be examined by daily family agency rules. In order to protect the security of transactions, it is necessary to protect the third-party interests of the live broadcast platform companies. In the case of “failure” of the good faith acquisition mechanism, if a married user uses community property for recharging rewards beyond the daily family agency authority, such married user shall be deemed to have separate authority to dispose of relevant community property, but has violated his or her fiduciary duty to his or her spouse. One party of the spouse has the right to require the other party to compensate him or her for corresponding losses at the time of divorce or to request the court to terminate the system of community of property during marriage according to Article 1092 of the Civil Code or Item 1 of Article 1066 of the Civil Code.
