我国个人破产免责制度研究

Research on China’s Personal Bankruptcy Exemption System

摘要: 随着我国现代市场经济的发展，自然人活跃于各类市场经济活动的同时，逐渐也开始存在的愈来愈多的个人债务。近年来，个人破产免责制度逐渐成为个人破产制度的关键问题，我国对于个人破产免责制度的讨论也受到各学者的关注和争论。本文在了解目前存在的个人破产免责制度基本理论和研究现状基础上，对我国个人破产免责制度构建的必要性和可行性进行分析，根据我国各区个人破产免责制度试点进行现状分析，在对于构建个人破产免责制度方面应该对制度所需的具体规则方面进行细化，并建立相关配套措施。这样才能对今后构建该制度找到正确的方向。

Abstract: With the development of China’s modern market economy, while natural persons are active in various market economic activities, more and more personal debts gradually begin to exist. In recent years, the personal bankruptcy exemption system has gradually become a key issue in the personal bankruptcy system, and the discussion of the personal bankruptcy exemption system in China has also attracted the attention and debate of various scholars. Based on understanding the basic theory and research status of the existing personal bankruptcy exemption system, this paper analyzes the necessity and feasibility of the construction of personal bankruptcy exemption system in China, analyzes the current situation according to the pilot personal bankruptcy exemption system in various regions of China, and refines the specific rules required for the system in terms of constructing a personal bankruptcy exemption system, and establishes relevant supporting measures. In this way, we can find the right direction for the future construction of the system.
