Design of AI Tort Liability System

摘要: 飞速发展的人工智能技术为人类社会提供了便利与进步，但也带来了挑战与问题。在弱人工智能时代，旧有的侵权法框架仍能包容其侵权责任。但随着强人工智能的出现，以及对超人工智能的研究，基于人工智能的特性，旧有民事侵权法显然无法完全覆盖现有的、将有的人工智能的侵权责任分配问题。因此，应当对人工智能进行定性，研究讨论其特性，为人工智能“量身打造”侵权责任制度以应对其侵权后责任承担。

Abstract: The rapid development of artificial intelligence technology has provided convenience and progress for human society, but it has also brought challenges and problems. In the era of weak artificial intelligence, the old tort law framework can still accommodate its tort liability. However, with the emergence of strong artificial intelligence and the research of super artificial intelligence, based on the characteristics of artificial intelligence, the old tort law obviously cannot fully cover the existing and future artificial intelligence tort liability allocation issues. Therefore, artificial intelligence should be qualified, its characteristics should be studied and discussed, and a tort liability system should be “tailored” for artificial intelligence to cope with its post-infringement liability.
