浅析网络游戏盗窃和故意毁坏财物行为

摘要: 随着近年来互联网科技水平的不断提高，电子网络已基本成为每个家庭必备的电子设施。据统计，至2022年，我国互联网普及率已达73%，国民人均上网时长每周28.5小时。可见，我国大部分民众对电子网络的使用率已达到较高程度，电子网络与人们的生活密切相关。在网络电子游戏中，网民个人的游戏账号、游戏装备等作为虚拟财产，也是刑法所保护的财产性利益。虽然我国一直在加强网络安全环境的维护力度，但由于网络信息本身的复杂性和隐秘性，使网络犯罪行为难以追查，网民个人的财产利益受损后也往往难以追回。本文将针对在电子游戏中盗窃和故意毁坏他人财产利益的行为，通过分析其犯罪特点及存在的问题，以期提供对应的建议。

Abstract: With the continuous improvement of Internet technology in recent years, electronic network has basically become a necessary electronic facility for every family. According to statistics, by 2022, China’s Internet penetration rate has reached 73%, and the per capita online time is 28.5 hours per week. It can be seen that the utilization rate of electronic networks by most people in China has reached a high level, and electronic networks are closely related to people’s lives. In online electronic games, users’ personal game accounts and game equipment, as virtual property, are also property interests protected by criminal law. Although China has been strengthening the maintenance of the network security environment, because of the complexity and secrecy of the network information itself, it is difficult to trace the cyber crimes, and it is often difficult to recover the personal property interests of netizens after being damaged. This article will aim at stealing and intentionally destroying other people’s property interests in electronic games, and analyze its criminal characteristics and existing problems, with a view to providing corresponding suggestions.
