Recognition and Enforcement of China’s Civil Mediation Judgements in Common Law Countries

摘要: 作为我国独特的法院调解制度下的产物，民事调解书在跨境承认和执行时会因制度理解的差异而产生性质争议。本文通过梳理澳大利亚首次执行我国民事调解书的案例，明确法律适用并厘清了民事调解书的性质，同时分析了民事调解书在澳洲等普通法系国家承认和执行的成文法路径、普通法路径以及公约路径。我国应更积极地参与相关国际条约规则的制定并推动其批准生效，深化国际司法领域协调合作并推进国际民商事秩序合理发展。

Abstract: Originating from China’s distinctive court mediation system, the recognition and enforcement of civil mediation judgements within transnational disputes are prompted by divergent interpretations of this system. This article elucidates the legal application and essence of civil conciliation by meticulously examining instances of Australia’s implementation of civil conciliation enforcement. Additionally, it delves into the legislative, common law, and conventional routes taken for the recognition and enforcement of civil conciliation in Australia and analogous common law jurisdictions. To foster a more engaged global role, China ought to actively participate in formulating pertinent international treaties, advocating for their ratification and enactment. This endeavor should encompass a deepening of harmonized coordination and collaboration within the realm of international justice, thereby propelling the judicious evolution of the international civil and commercial framework.
