夫妻共有网络虚拟财产的分割问题

The Problem of Division of Virtual Property of Husband and Wife

摘要: 伴随着网络电子商务产业的迅速发展壮大，在我国有关夫妻离婚纠纷的司法实践中，网络虚拟财产如何分割的问题越来越困扰着司法工作人员。基于此，本文以此为主题展开研究。本文总共分为四个部分，首先，简单介绍网络虚拟财产的概念及其法律性质；其次，论述在离婚纠纷中分割夫妻共有的网络虚拟财产的可行性；再次，分析在离婚纠纷中分割夫妻共有的网络虚拟财产时存在的现实困境。经研究发现，我国司法实践中存在缺乏裁判依据、价值认定不规范、归属规则不明等困境。最后，在对上述问题进行归纳的基础上，对夫妻共同网络虚拟财产的离婚分割问题进行了论述和探讨。

Abstract: With the rapid development and growth of the online e-commerce industry, in the judicial practice of divorce disputes between spouses in China, the issue of how to divide online virtual property is increasingly troubling judicial staff. Based on this, this article conducts research on this topic. This article is divided into four parts. Firstly, a brief introduction is given to the concept and legal nature of online virtual property; Secondly, discuss the feasibility of dividing the shared virtual property of spouses in divorce disputes; Once again, analyze the practical difficulties in dividing the shared virtual property of spouses in divorce disputes. After research, it has been found that there are difficulties in China’s judicial practice, such as a lack of judicial basis, non-standard value determina-tion, and unclear attribution rules. Finally, on the basis of summarizing the above issues, the issue of divorce segmentation of virtual property in the joint network of spouses was analyzed and discussed.
