高校学生伤害事故中法律责任探究

Exploration of Legal Liability in Injury Accidents of College Students

摘要: 随着网络媒体的迅速发展，人们经常能在网上看到一些关于高校学生事故的新闻。这些高校学生伤害事故类型多样，产生原因复杂，处理起来困难，如果高校处理不善，或者处理不够及时，就会遭到各方的谴责和批评。然而，并不是所有的高校学生事故都需要高校承担所有责任，很多时候它涉及多方因素。因此，本文基于国家教育部出台的《学生伤害事故处理办法》，进一步厘清其中的权责关系，分析现阶段高校大学生伤害事故处理过程中存在的一些问题，认为应通过加快完善相关法律制度，加强对大学生的心理辅导和利用新媒体的力量营造良好的校园氛围来预防高校学生伤害事故的发生。

Abstract: With the rapid development of online media, people can often see some news about college student accidents on the Internet. These college student injury accidents are of various types, have complex causes and are difficult to deal with, and if colleges and universities do not deal with them well or in a timely manner, they will be condemned and criticised by all parties. However, not all college student accidents require colleges and universities to take all the responsibility, and very often it involves multiple factors. Therefore, based on the Measures for Handling Student Injury Accidents issued by the Ministry of Education of China, this paper further clarifies the relationship between rights and responsibilities, analyses some of the problems existing in the process of handling college student injury accidents at the present stage, and argues that we should accelerate the improvement of the relevant legal system, strengthen the psychological counselling for college students and use the power of the new media to create a good campus atmosphere for the prevention of student injury accidents in colleges and universities.
