慕课教育模式下著作权保护制度研究
Research on Copyright Protection System under the MOOC Education Model
摘要: MOOC教育(又称“慕课”)是网络技术快速发展和新时期教育资源重新分配、整合的结果。未来,以网络数字为载体的慕课教育模式将发挥着重大的作用。相较于传统教育来说,慕课在教学机制和运行机制方面都呈现出新的特征,因此,慕课对于我国传统教育模式带来一定冲击,主要表现在版权归属问题以及合理使用制度在慕课教育模式面前因缺少适用空间而陷入的理论困境。为了更好地将知识产权保护体系与慕课教学实施流程有机地结合起来,促进著作权保护制度与慕课教育实现过程的衔接,建议对现有制度进行合理规制,本文在借鉴域外立法例的基础上,提出在合理使用制度中增设一般性适用条款和法定许可制度的对策,为国内高校慕课开展版权信息服务扫清障碍。
Abstract: MOOC Education System (also known as “MOOC”) is the combination of the rapid development of network technology and the redistribution and integration of educational resources in the new era. In the process of future education development, MOOC education mode based on online digital media will play a significant role. Compared to traditional education, MOOC has shown new characteristics in terms of teaching and operating mechanisms. Therefore, MOOC has brought a certain impact on China’s traditional education model, mainly manifested in the issue of copyright ownership and the theoretical dilemma of the fair use system in the face of MOOC education model due to the lack of applicable space. In order to better integrate the intellectual property protection system with the implementation process of MOOC education, and promote the connection between the copyright protection system and the implementation process of MOOC education, it is recommended to regulate the existing system reasonably. Based on the reference of foreign legislative examples, the article proposes the countermeasures of adding general applicable clauses and legal licensing systems in the fair of use system, in order to clear the obstacle for domestic universities to carry out copyright information services in MOOC.
