著作人身权与著作财产权冲突的协调路径

Paths to Coordinating Conflicts between Copyright Personal Rights and Copyright Property Rights

摘要: 我国著作权法将著作权分为著作人身权和著作财产权，大致采取的是“二元论”观点。但是实践中，著作人身权与著作财产权在行使时不可避免会产生一定的冲突，并且随着网络的发展，著作人身权与著作财产权之间的冲突愈演愈烈，然而目前我国立法尚未明确冲突的解决。基于文献阅读，本文将以著作权内部结构演化的历史背景为起点，具体阐述著作人身权与著作财产权之间的冲突，最终得出著作人身权与著作财产权之间的冲突并非不可协调的结论，并且就如何解决冲突提出了相应建议。

Abstract: Copyright Law of the People’s Republic of China divides copyright into personal rights and property rights, and generally adopts a “dualism” view. However, in practice, the exercise of personal rights and property rights will inevitably produce certain conflicts, and with the development of the network, the conflict between personal rights and property rights is getting more and more intense while the current legislation in China has not yet clarified the resolution of the conflict. Based on the literature reading, this paper will take the historical background of the evolution of the internal structure of author’s right as the starting point, specify the conflicts between the personal right and the property right of authorship, and the ultimate conclusion is that the conflicts between them are not irreconcilable. Also, this paper will put forward some suggestions on how to coordinate the conflict.
