自媒体时代短视频的侵权问题探析

Analysis on Infringement of Short Video in We-Media Era

摘要: 随着自媒体时代的快速发展，短视频行业开始兴起，受到广大群众的喜爱。本文将以自媒体短视频为研究对象，介绍其发展背景及现状，明确其法律定性，并分析得出自媒体短视频保护存在的现实困境，主要是短视频侵权方式更加隐蔽、避风港规则适用难度大以及短视频平台的注意义务缺失。最后对自媒体短视频的未来发展提出改进建议，主要从四个方面进行改进，要完善短视频侵权相关的法律法规，完善避风港规则的适用，同时增设网络短视频平台的注意义务，最重要的是要提高创作者和受众的版权保护意识。

Abstract: With the rapid development of the we-media era, the short video industry has begun to rise and is loved by the masses. This paper will take we-media short video as the research object, introduce its development background and current situation, clarify its legal characteristics, and analyze the practical difficulties arising from the protection of short media video, which are mainly the more hidden infringement methods of short video, the difficulty of applying the safe harbor rules and the lack of duty of care of short video platforms. Finally, the paper puts forward suggestions for improvement of the future development of we-media short video, mainly from four aspects: to improve the laws and regulations related to short video infringement, improve the application of safe harbor rules, add the duty of care of network short video platforms, and the most important thing is to improve the copyright protection awareness of creators and audiences.
