著作权法视角下生成式人工智能产物的权益确认与保护

Recognition and Protection of Interests in Generative Artificial Intelligence Products under the Perspective of Copyright Law

摘要: 随着科技飞速发展，生成式人工智能技术崭露头角，为传统的著作权带来了诸多挑战，与此相关的产物著作权问题也成为法学界与科技界的关注热点。本文通过文献调查与案例分析发现，当前的著作权法律体系和技术手段并未完全适应人工智能产物的著作权保护需求。为了维护使用人的合法权益，同时促进人工智能技术新兴产业的健康发展，本文建议在现有基础上进一步完善法律，并确定生成式人工智能产物的作品属性，以赋予其著作权法规定的保护模式与合法利益。

Abstract: With the rapid development of science and technology, generative artificial intelligence technology has emerged, bringing many challenges to the traditional copyright, and the related product copyright has become a hot spot of concern in the legal and scientific circles. Through literature survey and case analysis, this paper finds that the current copyright legal system and technical means are not fully adapted to the needs of copyright protection of AI products. In order to safeguard the legitimate rights and interests of users and promote the healthy development of the emerging indus-try of AI technology, this paper suggests that the law should be further improved on the basis of the existing legislation, and to determine the attributes of generative AI products, so as to give them the protection modes and legitimate interests stipulated in the copyright law.
