刑事司法中经验法则适用的现状与反思

Current Situation and Reflection on the Application of the Rule of Thumb in Criminal Justice

摘要: 随着刑事诉讼解释及刑事诉讼规则对“经验法则”有了更加明显的体现，“经验法则”在我国刑事诉讼法领域的地位也越加凸显。这就对经验法则在刑事司法中的适用提出了更多要求，但受到相关立法迟缓、经验法则自身特性掣肘以及适用主体自身原因影响等因素，经验法则在刑事司法中面临着许多现实困境与挑战。有鉴于此，应当反思经验法则在实践中存在的问题，并从完善有关经验法则的立法规定、增强对经验法则适用的认知程度以及提高法官适用经验法则的本领等方面全方位探求刑事司法中经验法则的适用进路。

Abstract: Along with the criminal procedure interpretation and criminal procedure rules to “the rule of experience” has more obvious embodiment, “the rule of experience” in the field of criminal procedure law is more and more prominent. This puts forward more requirements for the application of the rule of thumb in criminal justice, but due to the slow legislation, the characteristics of the rule of thumb itself and the influence of the quality of the applicable subject, the rule of thumb is faced with many practical difficulties and challenges in criminal justice. In view of this, we should reflect on the problems existing in the practice of the rule of thumb, and explore the application of the rule of thumb in criminal justice from the aspects of perfecting the legislative provisions of the rule of thumb, enhancing the cognition of the nature of the rule of thumb and improving the ability of judges to apply the rule of thumb.
