《中欧全面投资协定》中可持续发展条款及中国应对之策

Sustainable Development Provisions in “China-EU Comprehensive Investment Agreement” (CECA) and China’s Response to Them

摘要: 《中欧全面投资协定》中的可持续发展条款和专门解决可持续发展争端的分歧处理机制将会在分歧处理机制的适用范围、与其他争端解决程序的适用关系、东道国的规制权、国内法义务、国际公约义务等方面给我国带来挑战。分析借鉴欧盟可持续发展争端解决的实践，可以提出厘清可持续发展分歧处理机制适用范围、谨慎使用可持续发展规制权、完善国内可持续发展规则立法，提升环境和劳工标准、推进国际公约的批准，衔接可持续发展规则的应对之策。

Abstract: The sustainable development provisions in “China-EU Comprehensive Investment Agreement” and the dispute settlement mechanism specializing in sustainable development disputes will pose challenges to China in terms of the scope of application of the dispute settlement mechanism, its relationship with other dispute settlement procedures, the host country’s right to regulate, and the obligations under domestic law and international conventions. By analyzing and drawing on the practice of the European Union in sustainable development dispute settlement, we can propose measures to clarify the scope of application of the sustainable development dispute settlement mechanism, prudently use the right to regulate sustainable development, improve domestic legislation on sustainable development rules, upgrade environmental and labour standards, promote the ratification of international conventions, and connect the rules of sustainable development.
