机动车交通事故中夫妻间人身侵权问题研究

Research on Personal Tort between Husband and Wife in Motor Vehicle Traffic Accidents

摘要: 当夫妻之间发生交通事故导致人身侵权纠纷时，涉及婚姻家庭伦理与人身权利的权衡问题，在司法实践中引发了争议。本文通过对司法判决的分析，指出了一般侵权和婚内侵权之间的区别，明确了当前在归责体系方面存在的不足，并进一步提出了夫妻间机动车交通事故人身侵权问题的归责路径，包括责任的承担、免责事由和责任的实现方式，以期为解决类似争议提供思路，推动加强对夫妻间受侵害一方的人身权益保障。

Abstract: When a traffic accident occurs between husband and wife leading to a personal tort dispute, the issue of balancing marriage and family ethics and personal rights has caused controversy in judicial practice. Through the analysis of judicial decisions, this paper points out the difference between general tort and marital tort, clarifies the shortcomings in the current attribution system, and further puts forward the attribution path for personal tort in motor vehicle traffic accidents between husband and wife, including the assumption of responsibility, the reasons for exemption and the realization of liability, in order to provide ideas for resolving similar disputes and promote the strengthening of the protection of the personal rights and interests of the aggrieved party between husband and wife.
