摘要: 近年来，在检察机关的牵头指引下，“一站式”取证救助中心建设开展的如火如荼。“一站式”取证救助机制是以被害人为核心的取证机制，旨在一次性收集被害人的陈述及相关的实物证据，最大化的减少询问的次数，保护被性侵儿童的身心健康。然而，由于立法保护不足，与现有制度衔接不力，实践运行情况不佳等问题，致使该救助机制未能充分发挥其效能，故亟需从优化立法保护、完善证据的收集与运用、平衡权利冲突以及解决实践中存在的各种问题等角度进行完善，使其充分发挥作用，达到有效保障未成年被害人权益的目的。

Abstract: In recent years, under the guidance of the procuratorial organs, the construction of a “one-stop” forensic assistance center has been carried out in full swing. The “one-stop” forensic assistance mechanism is a victim-centered forensic mechanism, aiming to collect victims’ statements and related physical evidence at one time, maximize the number of inquiries, and protect the physical and mental health of sexually assaulted children. However, due to the lack of legislative protection, weak connection with the existing system, poor practice and other problems, the rescue mechanism has failed to give full play to its effectiveness. Therefore, it is urgent to improve it from the perspectives of optimizing legislative protection, improving the collection and application of evidence, balancing conflicts of rights, and solving various problems existing in practice, so as to give full play to its role and achieve the purpose of effectively protecting the rights and interests of juvenile victims.
