Crime Status and Research Status of Rape Crimes from 2019 to 2021

摘要: 性侵犯罪一直以来就是各界关注的重点，从行为层面来看强奸案件社会危害性较大，从实践方面看此类案件常见高发，故此选取以强奸为首的性侵案件作为研究对象。分析强奸行为与准强奸行为的关系，明晰准强奸的三种行为类型，即趁机型强奸、麻醉型强奸与欺骗型强奸，从而将准强奸行为包含在强奸之中。由此选取2019年至2021年近三年的犯罪数据并统计强奸案件在年份，地域与其他案件并罚的情况。根据数据从犯罪人与被害人双重角度分析犯罪发生的原因，犯罪人与主流社会的游离与其自身的习惯个性，被害人性防御能力较低且缺乏安全防范意识都影响着犯罪的发生。综上将案件发生为节点将其分为三个阶段，从社会，家庭与当事人自身三方面入手，建立相关社会治理制度治理体系，加强性知识输出，提高自我控制能力和限制日常活动范围以减少此类案件案发率。

Abstract: The crime of sexual assault has always been the focus of attention from all circles. From the perspective of behavior, rape cases have great social harm, and in practice, such cases are common and high incidence, so the sexual assault cases led by rape are selected as the research object. Analyze the relationship between rape behavior and quasirape behavior, and clarify the three types of quasirape behavior, namely opportunistic rape, narcotic rape and deceptive rape, so as to include the quasirape behavior in the rape. Therefore, the crime data from the past three years from 2019 to 2021 was selected and the combined punishment of rape cases in the year, region and other cases was counted. According to the data, the causes of crime are analyzed from the dual perspective of the criminal and the victim. The freedom between the criminal and the mainstream society and its own habits and personality, the victim’s low sexual defense ability and lack of safety awareness all affect the occurrence of crime. To sum up, the occurrence of cases is divided into three stages, starting from the three aspects of society, family and the parties themselves, a relevant social governance system should be established to strengthen the output of sexual knowledge, improve self-control ability and limit the scope of daily activities to reduce the crime rate of such cases.
