浅析我国刑诉中的专家辅助人制度

A Brief Analysis of the Expert Assistant System in China’s Criminal Litigation

摘要: 随着我国经济社会的快速发展，科技更迭愈加频繁，刑事诉讼案件中所涉及的专业知识也越来越繁杂。在此背景下，我国引入了专家辅助人制度，此制度可以弥补法官专业知识的不足，有利于实现刑事诉讼程序的公平公正。该制度在我国已建立并运行十年，并且不断发展和完善，在刑事司法领域发挥了重要作用。本文对专家辅助人制度在我国的刑诉领域的发展变化以及现状进行了阐述，找到该制度有待解决的一些问题，提出通过确立专家辅助人的诉讼地位和明确专家辅助人的权利义务来健全我国的专家辅助人制度的建议，以期提高审判质量和辩护质量，实现程序正义，维护当事人的质证权，促进庭审实质化。

Abstract: With the rapid development of China’s economy and society, scientific and technological changes have become more frequent, and the professional knowledge involved in criminal litigation cases has become more and more complex. In this context, China introduced the expert assistant system, this system can make up for the lack of judges’ professional knowledge, conducive to the realization of the fairness and justice of criminal proceedings, the system has been established and operated in our country for ten years, and continues to develop and improve, in the field of criminal justice has played an important role, this article on the development and change of the expert assistant system in our country in the field of criminal procedure and the current situation, find some problems to be solved in the system. It puts forward suggestions to improve China’s expert assistant system by establishing the litigation status of expert assistants and clarifying the rights and obligations of expert assistants, with a view to improving the quality of trials and defenses, with a view to achieving procedural justice, safeguarding the parties’ right to cross-examine evidence, and promoting the substance of court trials.
