网络游戏著作权侵权判定研究
Research on Online Game Copyright Infringement Judgment
摘要: 随着网络游戏产业的迅速发展,网络游戏产业的盈利能力也随之增长,随之在网络游戏中出现了大量抄袭、改编等侵权行为,这对网络游戏市场的发展造成了极大的影响,并对网络游戏作者的合法权益造成了损害。目前,我国著作权法尚未对网络游戏进行单独的法律保护,对其著作权的作品属性也没有明确的规定,同时实践中将网络游戏进行拆分依据多种作品类型对其著作权进行保护也存在争议。解决此类侵权案件首先要明确侵权责任,而对其进行正确的判断,则是决定网络游戏著作权侵权责任的关键。尽管在我国的立法中并没有明确的规定有关的侵权判定方法,但是在借鉴了国外的成熟经验和大量的司法判例之后,我国在实践中已经形成了一套完整的理论体系,即我国已经在具体的侵权案例中适用“思想与表达二分法”与“接触加实质性相似”等方法。文章重点讨论了网络游戏著作权侵权判定方法,通过对美国和国内的判决方式进行了对比,并对我国在应用中存在的问题进行了分析,在此基础上提出了相关的立法与司法建议。
Abstract: With the rapid development of the online game industry, the profitability of the online game industry has also increased, and a large number of infringement acts such as plagiarism and adaptation have appeared in online games, which has a great impact on the development of the online game market and has caused damage to the legitimate rights and interests of online game authors. At present, China’s copyright law has not yet provided a separate legal protection for online games, and there is no clear regulation on the property of their copyright works. In practice, it is also controversial to divide online games into different types of works to protect their copyright. To solve this kind of infringement case, we must first clarify the infringement liability, and make a correct judgment on it is the key to determine the copyright infringement liability of online games. Although there is no clear provision in the legislation of our country for the determination of infringement methods, but after learning from the mature experience of foreign countries and a large number of judicial precedents, China has formed a complete theoretical system in practice, that is, China has applied the “thought and expression dichotomy” and “contact plus substantial similarity” methods in specific infringement cases. This paper focuses on the judgment methods of online game copyright infringement, compares the judgment methods in the United States and in China, and analyzes the problems existing in the application in our country. On this basis, relevant legislative and judicial suggestions are put forward.
