未成年人保护问题研究——以反家暴为视角

Research on the Protection of Minors: From the Perspective of Anti-Domestic Violence

摘要: 在家庭暴力中，儿童作为弱势的一方通常是无法反抗的，他们依赖于父母，故需要对遭受家庭暴力的儿童给予高度重视。自2016年3月1日《中华人民共和国反家庭暴力法》施行以来，该法无疑给遭受家庭暴力的儿童带来了一定程度的保护，但与此同时，一些新的问题也开始出现，比如人身安全保护令的规定不够全面、强制报告的可操作性不强、庇护所形同虚设以及有待完善的监护权撤销制度。本文针对以上问题提出了一些相关建议，比如进一步细化人身安全保护令制度、增强强制报告制度的可操作性、充分发挥庇护所的作用以及完善监护权撤销制度，希望可以对未成年人家庭暴力的保护工作有所助益。

Abstract: In domestic violence, children are often unable to resist as vulnerable parties and are dependent on their parents, so children who are victims of domestic violence need to be given high priority. Since the implementation of the Anti-Domestic Violence Law of the People’s Republic of China on March 1, 2016, the law has undoubtedly dealt a certain degree of blow to the behavior of domestic violence, but at the same time, some new problems have begun to emerge, such as the incomplete provisions of personal safety protection orders, the inoperability of mandatory reporting, the ineffectiveness of shelters, and the guardianship revocation system that needs to be improved. This paper puts forward some relevant suggestions for the above issues, such as further refining the personal safety protection order system, enhancing the operability of the mandatory reporting system, giving full play to the role of shelters, and improving the guardianship revocation system, hoping to help protect minors from domestic violence.
