论行政处罚中通报批评研究

On the Notification of Criticism in Administrative Punishment

摘要: 通报批评作为一种行政处罚在适用时仍存在较大的争议。虽然通报批评作为行政处罚手段已被2021年《行政处罚法》明确列入其中，得到了行政机关的普遍适用。但对通报批评的定义、属性以及适用未做出具体规定，从而造成了通报批评的滥用。为了有效防止对行政相对人的合法权益的侵害，为行政实践提供一定的理论指导，行政法理论应当对通报批评展开更加系统的研究。

Abstract: As an administrative penalty, circulating a notice of criticism is still controversial in its application. Although circulating a notice of criticism has been directly stipulated as a means of administrative punishment into the Administrative Penalty Law revised in 2021, and is universally applied by the administrative organs, however, there are no specific provisions on the definition, attributes and application of circulating a notice of criticism, which leads to the abuse of it. In order to effectively prevent the infringement of the legitimate rights and interests of administrative counterparts and provide certain theoretical guidance for administrative practice, the theory of administrative law should carry out a more systematic study on it.
