论互联网平台垄断行为的法律规制

Research on Illegal Problems in Internet Platform Monopoly Behavior

摘要: 互联网平台为经网络信息技术下相互依赖的双边和多边主体在特定载体提供的规则下交互一起创造价值的商业组织形态。近些年互联网平台垄断问题在新冠疫情大流行背景下更加凸显，相比国外较为完备的反垄断法律体系，我国反垄断法律仍处于起步阶段，互联网平台垄断行为相关法律规制未来的发展与方向尚不明确，急需加速相关建设。本文研究结合国内互联网垄断行为和国外优秀法律规制，从完善我国现行相关法律，加强市场监管，注重消费者利益，政府的处罚与指导统一结合，建立全新体系的平台垄断法等方面出发，寻求我国数字平台反垄断新出路，推动互联网数字平台反垄断的立法和司法实践。

Abstract: The Internet platform enables the interdependent bilateral and multilateral subjects to interact under the rules provided by the specific carrier through the network information technology, so as to realize the business organization form that creates value together. In recent years, the problem of Internet platform monopoly has become more prominent under the background of the COVID-19 pandemic. Compared with the relatively complete anti-monopoly legal system abroad, China’s anti-monopoly laws are still in its infancy, and the future development and direction of relevant legal regulations on Internet platform monopoly behavior is not clear, and it is urgent to accelerate relevant construction. This paper studies the domestic Internet monopoly behavior and foreign excellent legal regulation, starting from perfecting the current relevant laws in China, strengthening market regulation, paying attention to the interests of the consumer, unifying the government’s punishment and guidance, establishing a new system of platform monopoly law, to seek new way antitrust digital platform, promote the Internet digital platform anti-monopoly legislation and judi-cial practice.
