新就业形态劳动者劳动权益保障研究——以北京外卖骑手为例

A Study on the Protection of Labor Rights and Interests of Workers in the New Employment Pattern—Taking the Beijing Takeaway Rider as an Example

摘要: 随着新技术的发展，新就业形态如外卖骑手等不断涌现，给社会和个人带来了新的机遇和挑战。本文以北京外卖骑手为例，探讨了新就业形态劳动者的劳动权益保障问题。本文首先分析了外卖骑手的特点和背景，然后从平台算法、劳动关系、职业发展、社会保障和维权意识等五个方面，剖析了外卖骑手的劳动权益保障现状和存在的问题，最后提出了相应的对策建议，包括加强行业监管、完善劳动关系认定、重视职业生涯指导、健全社会保障机制和提升骑手自身素质等。本文的创新点在于，本文从新就业形态的角度，对外卖骑手的劳动权益保障进行了系统的分析，提出了针对性的建议，为新就业形态的健康发展提供了理论和政策参考。

Abstract: With the development of new technologies, new forms of employment, such as takeaway riders, continue to emerge, bringing new opportunities and challenges to society and individuals. This paper takes Beijing takeaway riders as an example and discusses the labour rights and interests protection of workers in new employment forms. The paper first analyzes the characteristics and background of takeaway riders, then analyzes the current situation of labour rights and interests protection of takeaway riders and existing problems from five aspects, including platform algorithms, labour relations, career development, social security and awareness of rights protection, and finally puts forward corresponding countermeasures and suggestions, including strengthening the industry supervision, perfecting the identification of labour relations, attaching importance to career guidance, perfecting the mechanism of social security, and improving the riders’ own quality, etc. The innovation of this paper is that it systematically analyses the labour rights and interests protection of takeaway riders from the perspective of new employment pattern and puts forward targeted suggestions, which provides theoretical and policy references for the healthy development of new employment pattern.
