摘要: 在党的二十大报告中明确指出：“积极应对人口老龄化战略，逐步发展养老产业和养老事业已经成为一项的国家战略。”当前我国老龄化进程显著加快，老龄化问题背后的法治建设的盲点亦在不断涌现。本文将立足人口老龄化日趋严峻的背景下，分析养老服务法治建设必要性和存在的困境，结合现实以期对当下养老服务法治建设提供参考意见。

Abstract: In the report of the 20th National Congress of the Communist Party of China, it was clearly pointed out that “actively responding to the strategy of population aging and gradually developing the elderly care industry and career has become a national strategy.” Currently, the aging process in China has significantly accelerated, and blind spots in the construction of the rule of law behind the aging problem are also constantly emerging. This article will analyze the necessity and difficulties of the legal construction of elderly care services in the context of increasingly severe population aging, and combine reality to provide reference opinions for the current legal construction of elderly care services.
