个人电子商务经营者登记制度研究

Study on the Registration System of Individual E-Commerce Operators

摘要: 我国电子商务法从强制登记和豁免登记两方面规定了个人电子商务经营者的登记义务。但实施效果并不理想，相关信息未按照法律规定进行公示和披露。对于部分个人电子商务经营者，是否可以豁免登记依然存在争议。该部分电商经营者具有小商贩的属性，但由于网络业务的虚拟性、平台的较高的管理性，其与小商贩存在本质不同。因此可以将该部分电商经营者纳入登记范围内。可选择政府主导、平台主办的管理模式，实施事中的全过程监管，完善个人电子商务经营者的登记制度。

Abstract: China’s e-commerce Law stipulates the registration obligation of individual e-commerce operators from the two aspects of compulsory registration and exemption registration. However, the imple-mentation effect is not ideal, and the relevant information is not publicized and disclosed in accordance with the legal provisions. For some individual e-commerce operators, whether they can be exempted from registration is still controversial. This kind of e-commerce operators has the same characters with small traders, but due to the virtuality of network business and the high management of the platform, they are fundamentally different from small traders. So this part of e-commerce operators can be included in the scope of registration. The government-led and platform-sponsored management mode can be selected to implement the whole-process supervision in the process, and improve the registration system of individual e-commerce operators.
