“链上的艺术品”：国内数字藏品的交易流程、法律风险及对策

Artworks on the Blockchain: The Transaction Process, Legal Risks, and Countermeasures of Domestic Digital Collectibles

摘要: 2021年随着国外以太坊等公链交易日增，Web3.0的概念受到了人们广泛关注。数字藏品就是web3.0下NFT在国内的表现形式，其基于区块链而产生，国内数字藏品平台运行大致拥有IP授权、信息完善、发行(发售)、转售的流程，在其发展的同时，应警惕所存在的知识产权、底层技术以及金融相关风险，对于数字藏品，眼下当务之急不是禁止，而是应从两个视角在规避其风险的同时发挥它的最大效用，从内部视角来看，要求数字藏品平台做到自身合规是毋庸置疑的，从外部视角来看，中国立法者也能做出自己的努力来对数字藏品进行更好地保障与规制，以解决和应对这一法律领域所面临的挑战。

Abstract: In 2021, with the increasing number of public chain transactions such as Ethereum abroad, the concept of Web3.0 has received widespread attention. Digital collectibles are the manifestation of NFT in China under Web3.0, which is based on blockchain. Domestic digital collectibles platforms generally have processes such as IP authorization, information improvement, issuance (sale), and resale. While developing, they should be vigilant about the existing intellectual property, underlying technology, and financial related risks. For digital collectibles, the current priority is not to prohibit them, but from two perspectives, we should avoid its risks while maximizing its effectiveness. From an internal perspective, it is unquestionable to require digital collectibles platforms to achieve their own compliance. From an external perspective, Chinese legislators can also make their own efforts to better protect and regulate digital collectibles, in order to solve and respond to the challenges faced in this legal field.
