Study on the Legal Issues of Government Consumption Voucher

摘要: 在各地经济发展态势不佳时，为缓解消费能力下降问题，鼓励人们消费以此带动经济增长，各地政府以刺激经济为目标纷纷通过网络平台发放消费券。但由于消费券具有应急性作用，由此在实践过程中产生一系列负面作用以及缺乏相应法律进行规制，导致违反公平原则，政府发放消费券缺乏硬性规定和事后效果监督。通过完善相关法律法规，引入公平竞争审查制度，防止形成垄断，扰乱市场竞争，使得消费券真正发挥激发经济活力和保障市场有序进行的作用。

Abstract: In order to alleviate the problem of declining consumption capacity and encourage people to spend in order to boost economic growth, local governments have been issuing consumption vouchers through online platforms with the aim of stimulating the economy. But because the consumption voucher has the emergency function, thus produces a series of negative effects in the practice process as well as lacks the corresponding law to carry on the regulation, causes to violate the fair principle, there is no hard and fast rule for the government to issue consumption vouchers. By perfecting the relevant laws and regulations, introducing the fair competition review system, we can prevent the formation of monopoly and disturb the market competition.
