论《民法典》下网络虚拟财产的法律保护

On the Legal Protection of Network Virtual Property under the Civil Code

摘要: 随着互联网经济迅猛发展，网络虚拟财产在网络交易平台上被广泛使用，充分说明市场经济已经不再局限于现实空间，而是正在加速向网络空间拓展。在网络世界的虚拟财产交易中，诸多经济关系具有特殊性，使得传统法律机制难以与网络经济关系模式有效对接，也使得传统法律机制在网络虚拟财产交易中难以发挥有效的保障作用。本文将通过多角度综合分析，从探析网络虚拟财产法律属性与重要性切入，在确定网络虚拟财产价值评估方式、构建关于网络虚拟财产的新型权利关系、将网络虚拟财产列入遗产范围等方面提出具体建议，解决我国传统的法律制度在网络虚拟财产关系中的适用问题。

Abstract: With the rapid development of the Internet economy, the network virtual property is widely used on the network trading platform, which fully shows that the market economy is no longer limited to the real space, but is accelerating the expansion to the network space. In the virtual property transaction in the network world, many economic relations are special, which makes it difficult for the traditional legal mechanism to effectively connect with the network economic relationship mode, and also makes the traditional legal mechanism in the network virtual property transaction. Through comprehensive analysis from multiple angles, this paper will start from exploring and analyzing the legal attributes and importance of network virtual property, and put forward specific suggestions on determining the value assessment method of network virtual property, building a new right relationship on network virtual property, and including network virtual property in the scope of heritage, so as to solve the application problems of China’s traditional legal system in network virtual property relations.
