摘要: 在大数据时代，数据资源逐渐成为重要的生产要素和战略资源之一。我国信息产业飞速发展，为社会创造了巨大的价值。但与之相对的，数据获取、数据确权、数据使用、数据经营中的问题也日益突出，究其原因是我国对于承载于数据之上的权利即数据产权的相关问题还未得到解决。本文顺应数字经济时代的发展需要，意在针对现实存在的数据产权相关问题，通过明确“三权分置”的数据产权内容，界定个人数据、企业数据以及公共数据以构建数据产权基础法律制度。

Abstract: In the era of big data, data resources have gradually become one of the important production factors and strategic resources. The rapid development of China’s information industry has created tremendous value for society. However, on the other hand, the problems in data acquisition, data confirmation, data use, and data operation are becoming increasingly prominent, and the reason is that China’s problems related to the rights carried on data, that is, data property rights, have not been resolved. In response to the development needs of the digital economy era, this paper aims to construct a basic legal system of data property rights by clarifying the content of data property rights by clarifying the content of data property rights of “separation of powers”.
