摘要: 非现场执法活动中，行政机关借助电子技术监控设备获取客观事实从而进行事实认定，这要求获取客观事实的设备具备合法性。但在实践先行、立法不足状况下，存在电子技术监控设备设置不合理、设置程序缺失、维修检定不够严格等缺陷，使收集、固定违法证据的设备存在不合法的风险。因此，有必要进行源头治理，对非现场执法的前期准备阶段进行控制，坚持比例原则以求设置合理、设置公众听证环节完善设备设置程序、建立复查维修保养档案实现溯源管理，实现将电子技术监控设备行政化应用纳入法治轨道的目标。

Abstract: In off-site law enforcement activities, administrative organs obtain objective facts by means of electronic technology monitoring equipment so as to carry out fact determination, which requires the legality of the equipment that obtains objective facts. However, under the condition of practice first and insufficient legislation, there are defects such as unreasonable setting of electronic technology monitoring equipment, lack of setting procedures, and not strict enough maintenance verification, which makes the equipment collecting and fixing illegal evidence illegal risk. Therefore, it is necessary to carry out source management, control the preparatory stage of off-site law enforcement, adhere to the principle of proportion in order to set up reasonable, set up public hearings to improve equipment setting procedures, establish review maintenance files to achieve traceability management, and achieve the goal of integrating the administrative application of electronic technology monitoring equipment into the rule of law track.
