数字经济领域中电商平台反垄断行为规制

摘要: 随着经济全球化发展,数字经济逐步成为全球经济发展的新引擎,电商平台作为数字经济的重要组成部分,为现代经济发展的增添了新动能。然而,在以淘宝、京东、拼多多为首的超级电商巨头的崛起后,网络电商平台的竞争日趋激烈,市场资源逐渐集中于头部电商平台,电商平台的市场垄断问题凸显,如何通过反垄断规制体系提升常态化监管水平,引导电商平台在高质量发展、科技创新、国际竞争中发挥积极作用,是学界关注的重要议题。尽管我国为此出台一系列法律法规,但由于科技迅猛发展,如今出现了多种新型垄断行为,其已经远远超出传统反垄断范畴,为了有效规制电商平台的垄断行为,维护公平竞争,促进数字经济良性发展,重构反垄断法律体系迫在眉睫。
Abstract: With the development of economic globalization, the digital economy has gradually become a new engine for global economic development. As an important component of the digital economy, e-commerce platforms have added new momentum to modern economic development. However, with the rise of super e-commerce giants led by Taobao, JD.com, and Pinduoduo, competition among online e-commerce platforms has become increasingly fierce, and market resources are gradually concentrated on top e-commerce platforms. The problem of market monopoly on e-commerce platforms has become prominent. How to improve the level of normalized supervision through the anti-monopoly regulatory system, guide e-commerce platforms to play a positive role in high-quality development, technological innovation, and international competition, It is an important issue of concern in the academic community. Although China has introduced a series of laws and regulations for this, due to the rapid development of technology, various new types of monopolistic behaviors have emerged, which have far exceeded the traditional scope of anti-monopoly. In order to effectively regulate the monopolistic behavior of e-commerce platforms, maintain fair competition, promote the healthy development of the digital economy, it is urgent to reconstruct the anti-monopoly legal system.
