养老服务合同中意外事件免责条款的效力判断

Judgment on the Validity of the Accident Exclusion Clause in the Old-Age Service Contract

摘要: 无论是学术界还是实务界，养老服务合同中意外事件免责条款的效力判断标准一直未能达成共识。通过对司法案例的解读，得知该类型格式免责条款的效力判断主要争议在于《民法典》第497条中“合理性”的审查标准上。笔者重点对免责条款“合理性”的审查要素进行分析，试图构建“合理性”审查标准。经过对争议点的分析，笔者认为意外事件免责条款并非必然无效。

Abstract: No matter the academic circle or the practice circle, the judgment standard of the validity of the accident exclusion clause in the old-age service contract has not reached a consensus. Through the interpretation of judicial cases, we know that the main dispute in judging the validity of this type of form exemption clause lies in the examination standard of “rationality” in Article 497 of The Civil Code. The author focuses on the analysis of “rationality” of the exclusion clause and tries to construct the “rationality” review standard. After the analysis of the disputed points, the author believes that the accident exclusion clause is not necessarily invalid.
