浅析老年非婚同居中的财产权益保护

Analysis of Property Rights and Interests Protection in Elderly Non-Marital Cohabitation

摘要: 非婚同居是在社会现实和当事人自由抉择的双重影响下，形成的一种新型生活形式，老年人是非婚同居的主要群体。因我国法律在相关领域有所缺失，大多数老年人权利意识薄弱，加之非婚同居财产权利归属和责任承担并不明晰，导致老年非婚同居者的财产权益保护问题尤为突出。本文通过界定老年非婚同居概念、分析老年非婚同居财产关系中存在的问题，提出从完善财产纠纷的法律调整方式、倡导老年人订立非婚同居财产协议、规范老年非婚同居者的财产归属与债务承担责任三个方面对老年非婚同居者的财产权益进行保护。

Abstract: Non-marital cohabitation is a new form of life formed under the dual influence of social reality and the free choice of the parties involved. The elderly are the main group of non-marital cohabitation. Due to the lack of relevant laws in China, the majority of elderly people have weak awareness of their rights, and the unclear ownership and responsibility of property rights in non-marital cohabitation, the issue of protecting the property rights and interests of elderly non-marital cohabitants is particularly prominent. This article defines the concept of elderly non-marital cohabitation, analyzes the problems in the property relationship of elderly non-marital cohabitation, and proposes to protect the property rights and interests of elderly non-marital cohabitants from three aspects: improving the legal adjustment methods for property disputes, advocating for the elderly to enter into non-marital cohabitation property agreements, and regulating the property ownership and debt liability of elderly non-marital cohabitants.
