家庭暴力人身安全保护令问题研究

Research on the Issue of Personal Safety Protection Orders for Domestic Violence

摘要: 家庭暴力一直是突出的社会问题，我国《反家庭暴力法》对于家庭暴力的预防和规制已做出了相关规定，但仍有亟待完善之处。本文主要分析我国《反家庭暴力法》在人身安全保护令方面存在的问题及原因，指出我国现有法律在新型家庭暴力等方面存在规制空白。如何发挥人身安全保护令的应有作用、更好地保护家庭暴力受害者的合法权益，应进一步厘清家庭暴力的内涵和外延，将性暴力、精神控制等新型家庭暴力纳入法律规制范围。同时，在人身安全保护令的具体实践中，应降低取证门槛，根据当事人提出的人身安全保护令内容的不同采用不同的证明标准。此外，应增加人身安全保护令的内容，明确执行主体的分工与责任，更好保护家庭暴力受害者的合法权益。

Abstract: Domestic violence has always been a prominent social problem, and China’s Anti-Domestic Violence Law has made relevant provisions on the prevention and regulation of domestic violence, but there are still urgent areas for improvement. This article mainly analyzes the problems and reasons of the Personal Safety Protection Order in China’s Anti Domestic Violence Law, and points out that there are regulatory gaps in China’s existing laws in areas such as new types of domestic violence. How to give full play to the due role of personal safety protection orders and better protect the legitimate rights and interests of victims of domestic violence, we should further clarify the connotation and extension of domestic violence, and include new types of domestic violence such as sexual violence and mental control in the scope of legal regulation. Meanwhile, in the specific practice of personal safety protection orders, the threshold for evidence collection should be lowered, and different proof standards should be adopted according to the different contents of personal safety protection orders proposed by the parties involved. In addition, the content of personal safety protection orders should be added, clarifying the division of labor and responsibilities of the executing parties, and better protecting the legitimate rights and interests of victims of domestic violence.
