Risk Warning of Legal Risks Related to NFT—Case Study of NFT in Domestic and Overseas

摘要: 当前域内外存在大量涉NFT案例，通过对案例中的案件事实、争议焦点、法院裁判的梳理，探析NFT数字藏品领域存在的法律风险并提出综合性应对措施。域外涉NFT纠纷包括利用NFT进行非法获益违法犯罪和涉NFT商标侵权纠纷，其所涉及的风险主要是金融类风险以及多元化商标侵权风险。而国内的涉数字藏品纠纷多集中于著作权人维权以及消费者维权纠纷领域，主要反映版权侵权风险、消费者权益受损风险以及数藏平台资质缺失的风险。通过分析风险产生的原因，并借鉴域外经验，需要从数字藏品类别、平台综合治理方向进行数字藏品法律风险防御。

Abstract: At present, there are a large number of cases involving NFT in the domestic and overseas. Based on sorting out the facts, focus of dispute, and court rulings in these cases, the article explores the legal risks in the field of NFT and proposes the comprehensive countermeasures. Extra-territorial disputes involving the NFT include illegal and criminal activities involving the use of NFT to gain illegal benefits and disputes involving the NFT trademark infringement, and the risks involved in such disputes mainly include financial risk and diversified trademark infringement risk. The disputes involving digital collections in China mostly focus on the rights of copyright owners and the rights and interests of consumer, mainly reflecting the risk of copyright infringement, the risk of damage to consumers’ rights and interests and the risk of lack of qualification of digital collections platforms. By analyzing the causes of risks and learning from experience of foreign countries, it is necessary to defend against legal risks of digital collections from the aspects of categories of digital collections and comprehensive management of platforms.
