地理标志实践保护的路径优化——基于广东省佛山市的考察

Path Optimization for Practical Protection of Geographical Indications—Based on the Investigation of Foshan City, Guangdong Province

摘要: 地理标志作为一项具有经济价值、文化价值、社会价值的知识产权，在社会生产中的地位举足轻重。本文从地理标志创造、运用、保护三大环节入手，对正在拟申报地理标志的张槎沙口笋和国家地理标志石湾玉冰烧酒、顺德伦教糕等产品进行实地调研，摸清产业发展现状。进而基于地理标志的关联性要素和经济学分析并结合实地调研所得资料，剖析佛山市地理标志的保护现状，得出地理标志面临的申请确权困难、转型升级受限、产品营收不足、外部假冒伪劣等症结。最后结合实地调研所得的地理标志实践现状和分析得出的问题，为地理标志的行政革新、企业转型、营收增加、意识普及几方面提出路径优化的建议。

Abstract: Geographical indications, as an intellectual property with economic, cultural, and social value, play a crucial role in social production. Starting from the three major links of geographical indication creation, application, and protection, field research was conducted on products such as Zhangcha Shakou Bamboo Shoots, National Geographic Indication Shiwan Yubing Shaojiu, Shunde Lunjiao Cake, etc. that are currently being applied for geographical indications, in order to understand the current status of industrial development. Based on the correlation elements of geographical indications and economic analysis, combined with field research data, this study analyzes the current protection status of geographical indications in Foshan City, and identifies the difficulties faced by geographical indications in applying for property rights confirmation, limited transformation and upgrading, insufficient product revenue, and external counterfeiting and shoddy products. Finally, suggestions for path optimization are proposed for administrative reform of geographical indications, enterprise transformation, revenue increase, and awareness popularization.
