《反垄断法》视野下的电商平台“二选一”排他性交易行为法律规制研究

Research on the Legal Regulation of “Either-or” Exclusive Trading Behavior of E-Commerce Platforms from the Perspective of the Anti-Monopoly Law

摘要: 大数据时代，互联网平台经济发展迅速，依托互联网产生的电商平台实施“二选一”排他性交易行为愈发恶劣，对于社会和经济市场均产生了较大的不良影响。从当前司法实践来看，我国主要依靠反垄断法对电商平台不法行为加以规制，但治理效果收效甚微。本文通过分析总结域外反垄断规制的方法和经验，重点说明了界定《反垄断法》中的“市场”、明确滥用优势地位的要件、完善损害赔偿责任制度这三个方面，为《反垄断法》对于规制电商平台进行排他性交易行为提出完善建议。

Abstract: In the era of big data, the Internet platform economy has developed rapidly, and the “one out of two” exclusive trading behavior of e-commerce platforms based on the Internet has become more and more severe, which has had a greater negative impact on the social and economic markets. From the current judicial practice, China mainly relies on the Anti Monopoly Law to regulate illegal activities on e-commerce platforms, but the effectiveness of governance has been minimal. This article analyzes and summarizes the methods and experiences of antitrust regulation outside the domain, focusing on defining the “market” in the Anti Monopoly Law, clarifying the elements of abusing advantageous positions, and improving the system of liability for damages. It provides suggestions for improving the Anti Monopoly Law’s regulation of exclusive trading behavior on e-commerce platforms.
