数字化行政方式及其法律规制研究

摘要: 随着互联网、区块链、AI数据大模型等数字技术的发展，数字政府和数字行政成为世界多数国家和地区愈加重视的领域，技术进步带来的变革已经渗透到了行政法领域，数据算法嵌入下的传统行政行为发生了深刻的变革。数字化行政方式在打破时间空间束缚，提高行政效率，便利相对人获取权利，保障公平公正的规制效果实现的同时也引发了行政领域的诸多风险和问题。因此有必要研究数字化行政方式的法律规制及其界限，在平衡技术理性和法治追求的背景下使其遵循行政法基本原则，在提升社会治理效能和维护公民合法权益的正确轨道上运行。

Abstract: With the development of digital technology such as the Internet, blockchain, AI data big model, digital government and digital administration have become a field that most countries and regions in the world pay more and more attention to, and the changes brought by technological progress have penetrated into the field of administrative law, and the traditional administrative behaviors embedded in data algorithms have undergone profound changes. Digital administrative methods break the time and space constraints, improve administrative efficiency, facilitate access to the rights of the relative, and ensure the realization of fair and just regulation effect at the same time also trigger a lot of risks and problems in the field of administration. Therefore, it is necessary to study the legal regulation of digital administration and its boundaries, in the context of balancing technical rationality and the pursuit of the rule of law, make it follow the basic principles of administrative law and operate on the right track of enhancing the effectiveness of social governance and safeguarding the legitimate rights and interests of citizens.
