论电子商务平台安全保障义务研究

Research on E-Commerce Platform Security Guarantee Obligation

摘要: 随着互联网经济的快速发展，电子商务产业在人们生活中扮演了越来越重要的角色，但也正是由于电子商务发展的速度过快，平台提供的各类商品服务越来越多，平台经营者在日常交易过程中的问题也日益凸显出来，电子商务平台是平台内经营者与买家交易中不可或缺的一个环节，平台需要承担相应的义务，18年《电子商务法》的出台，展现了国家在立法层面对于电商平台出现的问题的重视，其中38条规定了涉及生命健康的商品或服务的安全保障义务，但是法条的规定较为粗略，对于安全保障义务的内容和认定标准模糊，安全保障义务中的相应责任未给予明示，造成了实务界和理论界的争议。笔者从安全保障义务的基本概念出发，对安全保障义务的范围、内容、以及相应责任进行分析归纳。对电商平台安全保障义务的完善提出建议，更好地促进电子商务产业发展。

Abstract: With the rapid development of the Internet economy, e-commerce industry has played an increasingly important role in people’s lives. However, it is precisely because of the rapid development of e-commerce that more and more commodities and services are provided by the platform, and the problems of platform operators in daily transactions have become increasingly prominent. E-commerce platform is an indispensable link in the transaction between operators and buyers within the platform, and the platform needs to undertake corresponding obligations. The promulgation of the E-Commerce Law in 2018 shows that the state attaches great importance to the problems arising from e-commerce platform at the legislative level. Among them, 38 articles stipulate the safety protection obligations of goods or services involving life and health, but the provisions of the law are relatively rough. The contents and standards of the safety guarantee obligation are vague, and the corresponding responsibilities in the safety guarantee obligation are not explicitly stated, which causes disputes in the practical and theoretical circles. Starting from the basic concept of security guarantee obligation, the author analyzes and concludes the scope, content and corresponding responsibility of security guarantee obligation. Suggestions on the improvement of e-commerce platform security obligations are put forward to better promote the development of e-commerce industry.
