流浪动物投喂人责任承担探究——以某地流浪动物伤人案为例

Research on the Responsibility of Stray Animals Feeding People—Taking a Stray Animal Wounding Case as an Example

摘要: 近年来，流浪动物伤人案件频繁发生，但是由于流浪动物无人管理，长期处于四处流浪的状态，很难找到流浪动物的原饲养人和管理人，被侵权人难以通过找到原饲养人的方式进行救济，因此被侵权人通常会找与流浪动物有联系的投喂人承担责任。但是由于没有明确的法律规定，法院在进行裁判时也会基于不同的利益衡量而做出不同的判决，同案不同判的现象经常发生，长此以往会破坏司法的公信力。本文以实践中发生的流浪动物伤人案件为切入点，对流浪动物投喂者侵权责任承担进行分析，并提出相关的完善建议，以期该问题能够得到更好的解决。

Abstract: In recent years, cases of stray animals hurting people have occurred frequently. However, since stray animals are unmanaged and in a wandering state for a long time, it is difficult to find the original breeders and managers of stray animals, and it is difficult for the infringed to find the original breeders for relief. Therefore, the infringed usually find the feeders who are in contact with stray animals to bear the responsibility. However, due to the lack of clear legal provisions, the court will make different judgments based on different interests, and the phenomenon of different judgments in the same case often occurs, which will destroy the credibility of the judiciary in the long run. This paper takes the stray animal injury cases in practice as the breakthrough point, analyzes the infringement liability of stray animal feeders, and puts forward relevant suggestions to improve the problem, so as to get a better solution.
