Legal Responsibility and Protective Measures of Intellectual Property Infringement in Cross-Border Electronic Commerce

摘要: 在全球化和数字化时代，跨境电子商务作为推动国际贸易和经济增长的重要力量，同时带来了知识产权保护方面的显著挑战。本研究揭示了跨国企业在全球化经营中可能遇到的文化敏感性和知识产权保护的复杂性。研究指出，尊重文化差异、深入理解国际知识产权法律的复杂性，以及在设计创新与保护原创性之间找到平衡点，对于跨境电子商务中的知识产权保护至关重要。应对这些挑战，研究建议加强国际合作、利用先进技术增强保护效率，以及完善电子商务平台的自我监管机制。此项研究旨在为构建健康、公平的全球电子商务环境提供策略建议，确保知识产权的有效保护。

Abstract: In the era of globalization and digitalization, cross-border e-commerce, as an important force driving international trade and economic growth, has also brought significant challenges in the protection of intellectual property rights. Through case studies, especially focusing on the “plagiarism” of Spanish fast fashion giant Zara in the Chinese market, this study reveals the cultural sensitivities and complexities of intellectual property protection that multinational companies may encounter in their global operations. The study points out that respecting cultural differences, understanding the complexities of international IP law, and finding a balance between design innovation and the protection of originality are essential for IP protection in cross-border e-commerce. To address these challenges, the study recommends strengthening international cooperation, using advanced technologies to enhance protection efficiency, and improving the self-regulatory mechanism of e-commerce platforms. The aim of this study is to provide strategic recommendations for building a healthy and fair global e-commerce environment to ensure the effective protection of intellectual property rights.
