法理学视域下网络暴力的分析和治理

Analysis and Governance of Cyber Violence from the Perspective of Jurisprudence

摘要: 互联网科技的发展带来了便捷的信息传播和交流，改变了我们传统的生活方式的同时也催生了网络暴力现象，侵害了他人隐私和名誉，造成了恶劣的社会影响，已经成为一个亟待关注的问题。因此需从法理学的角度，对网络个体自由权利、自由与秩序价值间的冲突进行法理维度检视，并以价值位阶和比例原则来平衡价值冲突，健全网络法治和公权力信息公开体系，优化平台、媒体和网民的主体责任结构，为我国网络信息生态空间建设提供关键性理论支撑，帮助构建和谐网络环境，从而建设社会主义法治社会。

Abstract: The development of Internet technology has brought convenient information dissemination and exchange, changed our traditional way of life, and also gave birth to the phenomenon of online violence, infringing on the privacy and reputation of others, causing a bad social impact, which has become an urgent concern. Therefore, from the perspective of jurisprudence, it is necessary to examine the conflict between the freedom rights, freedom and order values of online individuals in the legal dimension, and balance the value conflict with the principle of value hierarchy and proportionality, improve the network rule of law and public power information disclosure system, optimize the main responsibility structure of platforms, media and netizens, provide key theoretical support for the construction of China’s network information ecological space, and help build a harmonious network environment, so as to build a socialist society under the rule of law.
