人工智能生成物的著作权保护问题研究

摘要: 人工智能是近几年的热门话题，它的出现为人类社会带来了巨大的便利，但随之而来也有许多问题。其中应用最为广泛，争议较多的就是人工智能生成物。计算机技术的提升，使得人工智能具有更强大的功能，其生成文字、音乐等的周期越来越短，种类越来越丰富，受众群体也日渐扩大，但是我国关于人工智能生成物的立法还处于空白状态，这显然是不利于新生事物发展的。本文通过对人工智能是否属于创作的主体、人工智能生成物是否属于作品、其著作权归属如何认定、以及人工智能生成物的真实性等问题的探讨，探寻适合我国人工智能生成物的著作权保护模式，以期解决现实的人工智能领域法律纠纷，并推动人工智能良性发展。

Abstract: Artificial intelligence is a hot topic in recent years; its emergence has brought great convenience to human society, but also many problems. The most widely used, more controversial is the artificial intelligence products. The improvement of computer technology, making artificial intelligence has more powerful functions, its generation of text, music and other cycles are shorter and shorter, more and more rich, the audience is expanding, but our country’s legislation on artificial intelligence products is still in a blank state, which is obviously not conducive to the development of new things. This paper through the artificial intelligence belongs to the subject of creation, whether the artificial intelligence products belong to the work, how to determine the ownership of the copyright and the authenticity of artificial intelligence generated products and other issues, explore suitable for our country’s artificial intelligence products copyright protection mode, in order to solve the real legal disputes in the field of artificial intelligence, and promote the benign development of artificial intelligence.
