摘要: 人创造了文化，文化即人化，文化与人存在密不可分的关系，法律文化与文化是一种从属关系，人创造法律文化。中西方由于地理环境、人文、经济模式等方面的差异，导致中西方法律文化中关于人的本质、人性价值取向等方面也存在差异，从而形成了各自独特的文化类型及其思维方式和社会特点。中西方对人性的不同认识，导致古代中西方不同的人治与法治走向。

Abstract: People create culture, culture is humanized, culture and people have an inseparable relationship, legal culture and culture is a subordinate relationship, people create legal culture.
