家庭暴力告诫制度在公安工作中的实证研究——基于江苏五地的调研数据

An Empirical Study on the Domestic Violence Warning System within the Public Security Field—Based on the Survey Data of Five Regions in Jiangsu Province

摘要: 家庭暴力告诫制度是我国反家暴法重要的制度创新，是公安机关及时介入家庭暴力的经验总结，对于告诫加害人、保护受害人，发挥教育震慑在防治家庭暴力中的作用具有重要意义。通过对江苏省五地派出所(苏州、无锡、南京、淮安、连云港)的公安民警发放调查问卷并进行个别访谈，分析由此得出的数据，梳理该制度在实施中存在的问题，包括民警对家庭暴力及告诫制度理解不到位、告诫制度本身存在的立法缺陷以及社会各部门工作未形成闭环等，深化民警对告诫制度的认识，完善相关的立法规定，强化社会组织的协调联动。

Abstract: The Warning System of Domestic Violence is an important institutional innovation of China’s anti-domestic violence law, and is a summary of the experience of the public security organs’ timely intervention in domestic violence. It is of great significance to admonish the perpetrator, protect the victim, and play the role of education and deterrence in the prevention and treatment of domestic violence. Through the distribution of questionnaires and individual interviews to the policemen in the five police stations in Jiangsu Province (Suzhou, Wuxi, Nanjing, Huai’an, Lianyungang), the data obtained are analyzed, and the problems existing in the implementation of the system are sorted out, including the inadequate understanding of domestic violence and the admonition system by the policemen, the legislative defects of the admonition system itself, and the failure of the work of various social departments to form a closed loop. The policemen’s understanding of the admonition system is deepened, the relevant legislative provisions are improved, and the coordination of social organizations is strengthened.
