The Resolution Mechanism for Addressing Copyright Infringement Issues Related to ChatGPT’s Generated Content

摘要: 随着生成式人工智能的快速发展，ChatGPT等人工智能技术在文学、艺术和科学领域的应用日益广泛，然而，由此引发的著作权侵权问题亦不容忽视。解决ChatGPT生成物侵犯著作权问题的重点在于解决ChatGPT生成物的权利归属问题。所以应当综合考量由ChatGPT的使用者、设计者分别享有ChatGPT生成物的权利时的社会影响、利益分配情况因素，选择最适合社会现状的权利配置模式。在确定由ChatGPT的使用者享有ChatGPT生成物权利，由ChatGPT的设计者享有生成物“署名权”的权利构架之下，基于权利与义务相统一原则与该构架下侵权责任承担带来的社会效应，构建起了由ChatGPT使用者和设计者承担连带责任的侵权责任承担模式。

Abstract: With the rapid development of generative artificial intelligence, technologies such as ChatGPT are increasingly being applied in the fields of literature, art, and science. However, the issue of copyright infringement arising from this cannot be ignored. The key to addressing the issue of copyright infringement by ChatGPT’s generated content lies in determining the ownership of the rights to these outputs. Therefore, it is necessary to comprehensively consider the social impact and distribution of interests when ChatGPT’s users and designers separately enjoy the rights to the generated content, and select the most suitable rights allocation model based on the current social situation. Under the framework where ChatGPT’s users enjoy the rights to the generated content while the designers retain the “right of authorship,” we have established a model of joint and several liability for infringement accountability based on the principle of unity between rights and obligations and the social effects of liability assumption under this framework.
