摘要: 随着老龄化的加剧，衍生出智慧养老服务产业。老年人在享受智慧养老服务带来的便利时，其个人信息的保护也受到极大关注。信息收集者在收集、利用老年人个人信息时，老年人作为大数据中的弱势群体，老年人在个人信息收集、处理中的知情同意模式效力极易遭到弱化。权利损害后的救济机制不完善，老年人的权益得不到保障。在智慧养老模式下，应对老年人群体个人信息保护的困境，需要细化知情同意规则进行，健全老年人个人信息保护的法律机制，多方位保障老年群体的合法权益。

Abstract: With the intensification of aging, the intelligent elderly care service industry has been derived. When the elderly enjoy the convenience brought by smart elderly care services, the protection of their personal information has also received great attention. When information collectors collect and use the personal information of the elderly, the elderly are the vulnerable group in big data, and the effectiveness of the informed consent mode of the elderly in personal information collection and processing is easily weakened. The relief mechanism after right damage is not perfect, and the rights and interests of the elderly are not protected. Under the smart pension model, to deal with the dilemma of personal information protection of the elderly group, it is necessary to refine the informed consent rules, improve the legal mechanism for the protection of personal information of the elderly, and protect the legitimate rights and interests of the elderly group in various aspects.
