电子商务中消费者权益保护的法律问题
Legal Issues of Consumer Rights Protection in Electronic Commerce
摘要: 信息和通信技术的迅速发展催生了电子商务这一崭新的交易方式。电子商务对消费者的生活产生了深刻影响,降低了交易成本并提高了交易效率。然而,电子商务的便利性也引发了一系列法律问题,导致消费者权益受到损害。消费者权益的法律保护关系到消费者的人身财产安全。在当前新时代,建设健全消费者法律权益保护机制需要简化取证流程、提高处罚力度以及优化举证方式等多种策略。必须完善法律制度和执法机制,以增强消费者权益的法律保护力量。本文从消费者权益的内涵入手,总结了电子商务中侵害消费者权益的原因,分析了现行消费者权益保护法律的不足之处,并探讨了相应的解决对策,为电子商务中消费者权益保护提供有益的参考。
Abstract:
The rapid development of information and communication technology has led to the emergence of e-commerce as a new method of transactions. E-commerce has significantly impacted consumers’ lives by reducing transaction costs and enhancing transaction efficiency. However, the convenience of e-commerce has also raised various legal issues, potentially jeopardizing consumer rights. Safeguarding consumer rights is crucial for ensuring the safety of consumers, both personally and in terms of their property. In the modern era, establishing and enhancing mechanisms for protecting consumer legal rights and interests necessitates multiple strategies such as streamlining evidence collection, imposing stricter penalties, and optimizing methods of proof. It is imperative to enhance the legal system and enforcement mechanisms to bolster the protection of consumer rights and interests. This article delves into the essence of consumer rights and interests, identifies the factors leading to infringements in e-commerce, evaluates the deficiencies in current consumer protection laws, and proposes solutions to address these issues, offering valuable insights for safeguarding consumer rights and interests in e-commerce. Relevant references are provided for further exploration.
